Terms of Use

1. Acceptance of Terms

By downloading, installing, or using StillFresh (the "App"), you agree to these Terms of Use. If you don't agree, please don't use the App.

These Terms form a legally binding agreement between you and StillFresh. They apply to all users — free and paid.

2. Who Can Use StillFresh

You must be at least 13 years old to use StillFresh (or 16 in the EU/UK). If you are under the applicable minimum age, do not use the App.

By using the App, you confirm that you meet the minimum age requirement in your jurisdiction and that the information you provide is accurate.

3. Free Tier

StillFresh is free to download and use with the following features:

• Unlimited manual pantry item tracking
• AI image analysis to identify grocery items (up to 3 scans per week, maximum 2 photos per scan)
• Expiry date tracking, freshness reminders, and push notifications
• Usage dashboard showing waste and savings stats
• 1 AI recipe / meal plan generation per week

We reserve the right to adjust free-tier limits in future. We will give you reasonable notice of any reductions.

4. StillFresh Pro Subscription

StillFresh Pro is a paid subscription that unlocks:

• 100 pantry photo scans per week — scan your pantry up to 100 times every week.
• Multi-photo scanning — upload up to 5 photos at once to catalog your whole fridge.
• Unlimited AI meal plans / recipe generation — generate as many recipes as you want from your pantry inventory, with no weekly cap.

Subscription Plans

• Monthly — billed once per month. Renews automatically each month.
• Yearly — billed once per year. Renews automatically each year.

Current prices are shown at the point of purchase on the App Store or Google Play and may vary by region. Prices are set in your local currency by Apple or Google.

Auto-Renewal

Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your Apple ID or Google account will be charged within 24 hours before the end of the current period.

How to Cancel

• iPhone / iPad: Go to Settings → [your name] → Subscriptions → StillFresh → Cancel Subscription.
• Android: Open Google Play Store → tap your profile icon → Payments & subscriptions → Subscriptions → StillFresh → Cancel subscription.

When you cancel, you keep Pro access for the remainder of your paid billing period. After that, your account reverts to the free tier. Cancellation does not trigger a prorated refund for unused time.

Restore Purchases

If you reinstall the app or switch devices, use the "Restore Purchases" option in the app to recover your active subscription.

5. How Purchases Work

All in-app purchases are processed by Apple (on iOS) or Google (on Android). StillFresh does not handle your payment card information directly.

• iOS payments are governed by Apple's Media Services Terms and Conditions.
• Android payments are governed by Google Play's Terms of Service.

By making a purchase, you also agree to Apple's or Google's payment terms, as applicable. Subscription management (verification of entitlements) is handled by RevenueCat on our behalf.

6. Refunds

• Apple: Visit reportaproblem.apple.com to request a refund. Apple handles all billing disputes for iOS purchases.
• Google Play: Visit the Google Play Order History page (play.google.com/store/account/orderhistory) to request a refund. Google typically allows refunds within 48 hours of purchase.

If you believe you were charged in error or experienced a technical issue, contact us at [email protected] and we'll do our best to assist — including supporting your refund request with Apple or Google where appropriate.

7. Your Account

You are responsible for keeping your account credentials confidential. Don't share your password, and notify us immediately at [email protected] if you suspect unauthorised access.

We reserve the right to terminate accounts that violate these Terms. You can delete your account at any time by contacting us.

8. Acceptable Use

You agree not to:

• Use StillFresh for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or extract source code from the App.
• Circumvent or tamper with subscription or access controls.
• Upload images that contain illegal content, nudity, violence, or hate speech.
• Abuse the AI features by sending large volumes of automated requests or attempting prompt injection.
• Impersonate any person or entity, or misrepresent your affiliation.
• Interfere with or disrupt the integrity of StillFresh's servers or infrastructure.
• Use StillFresh to store or distribute malware or harmful code.

Violation of these rules may result in immediate account termination.

9. AI Features

StillFresh uses AI to analyse grocery photos and suggest recipes. Please note:

• AI outputs are not guaranteed to be accurate. Shelf-life estimates and freshness assessments are approximations based on general food science data, not a substitute for your own judgment.
• Always inspect food yourself before consuming it. If in doubt, throw it out.
• Recipe suggestions are AI-generated and have not been reviewed by nutritionists. They are for inspiration only.
• We are not liable for any food-related illness or harm arising from relying solely on AI-generated assessments.

10. Expiry & Freshness Estimates

StillFresh provides estimated expiry and freshness dates based on general food science data, typical shelf-life ranges, and information you enter. These estimates are not:

• The result of laboratory testing on your specific food items.
• A substitute for your own senses (sight, smell, texture).
• A guarantee that food is safe to eat up to or beyond any displayed date.
• Official food-safety certification of any kind.

By using the freshness and expiry features, you acknowledge that all dates shown are suggested estimates based on typical shelf-life data and that you are solely responsible for evaluating whether food is safe before consuming it.

Always check food yourself before eating it. If something looks, smells, or feels off — do not eat it, regardless of any date shown in the App.

11. Assumption of Risk

You acknowledge and accept that there is inherent risk in all food consumption decisions. By using StillFresh, you expressly assume that risk and agree that:

• Freshness and expiry estimates provided by the App do not replace your personal judgment.
• You are solely responsible for all food safety decisions you make based on, or in spite of, information shown in the App.
• StillFresh, its developers, and its operators are not liable for any illness, injury, property damage, or other harm arising from your reliance on the App's estimates, notifications, or freshness-extension results.

This assumption of risk applies whether or not the App's estimate proved inaccurate and regardless of the cause.

12. Official Food Safety Guidance

StillFresh is a convenience tool and is not a substitute for official food safety guidance. We encourage you to follow the recommendations of the relevant authority in your region, including:

• United States: U.S. Department of Agriculture (USDA) — foodsafety.gov — and the U.S. Food & Drug Administration (FDA).
• Canada: Canadian Food Inspection Agency (CFIA) — inspection.canada.ca.
• European Union / UK: European Food Safety Authority (EFSA) and the UK Food Standards Agency (FSA).
• Australia / New Zealand: Food Standards Australia New Zealand (FSANZ).

When in doubt, always defer to official guidance from your local health authority rather than relying solely on the App.

13. Intellectual Property

All content in the App (including but not limited to the interface design, logo, code, and branding) is owned by or licensed to StillFresh and is protected by copyright and other intellectual property laws.

Your pantry data and photos remain yours. By uploading photos or data, you grant us a limited licence to process them for the purposes described in this agreement and our Privacy Policy.

You may not reproduce, modify, or distribute any part of the App without our prior written consent.

14. Scope of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded or Android-branded products that you own or control, as permitted by the Usage Rules set forth in the applicable platform's terms of service (including the Apple Media Services Terms and Conditions or Google Play Terms of Service, as applicable). This license does not permit use of the App on any device you do not own or control, except as permitted through Family Sharing or equivalent account-sharing features where enabled by the platform.

15. Third-Party Terms of Agreement

Your use of the App is also subject to the terms of your wireless data service plan and any other applicable third-party agreements (including those of Apple or Google, as relevant to how you obtained the App). You are responsible for any data charges that may apply.

16. Disclaimer of Warranties

StillFresh is provided "as is" and "as available" without warranties of any kind, either express or implied — including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will always be available, error-free, or that AI-generated outputs will be accurate. Service interruptions may occur due to maintenance, updates, or factors outside our control.

17. Limitation of Liability

To the maximum extent permitted by applicable law, StillFresh and its operators, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to StillFresh will not exceed the greater of the amount you paid us in the 12 months preceding the claim or one hundred Canadian dollars (CAD $100).

Nothing in this Agreement excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under applicable law. Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you.

18. Mandatory Consumer Rights

Nothing in this Agreement excludes, restricts, or modifies any consumer guarantee, statutory right, or remedy available to you under the mandatory laws of your country, province, or state of residence that cannot lawfully be waived or limited by agreement. Where the law of your place of residence gives you a non-waivable right to bring a claim in your local courts or to rely on your local consumer protection law, the relevant provisions of this Agreement apply only to the maximum extent permitted by that law, and the remaining provisions continue in full force and effect. In the event of any conflict, this section prevails.

19. Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

20. Termination

We may suspend or terminate your access to StillFresh at any time if you violate these Terms, if required by law, or if we decide to discontinue the service with reasonable notice.

You may terminate your account at any time by emailing [email protected] with the subject "Delete My Account." We will process your request within 30 days.

Upon termination, your right to use the App ceases immediately. Sections 9–19 survive termination.

21. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes will be resolved through good-faith negotiation first; if that fails, through binding arbitration or the courts of Ontario, Canada, and you consent to the jurisdiction of those courts.

22. Severability

If any provision of this Agreement is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

23. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via an in-app notice or by emailing the address associated with your account at least 14 days before the changes take effect.

Continuing to use StillFresh after new Terms take effect constitutes acceptance of those Terms.

24. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• Acknowledgement: You acknowledge that this agreement is between you and StillFresh only, not with Apple. StillFresh is solely responsible for the App and its content. This Agreement does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions as of the effective date of this Agreement.
• Scope of License: The license granted to you under Section 14 with respect to iOS use is a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Maintenance and Support: StillFresh is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance and support services.
• Warranty: StillFresh is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be StillFresh's sole responsibility.
• Product Claims: StillFresh, not Apple, is responsible for addressing any claims of you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, StillFresh, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
• Third Party Beneficiary: Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
